  • Marital property settlements entered into by competent parties upon valid consideration for lawful purposes are favored in the law and such will be enforced unless their illegality is clear and certain. The party seeking to rescind a contract on the basis of unconscionability has the burden of proving the grounds of unconscionability by clear and convincing evidence. On appeal, the court reviews the evidence in the light most favorable to the prevailing party.
  • One spouse is not legally justified in leaving the other spouse simply because the marital relationship has gradually broken down.
