<li>Desertion is a breach of matrimonial duty, and is composed first, of the actual breaking off of the matrimonial cohabitation, and secondly, an intent to desert, in the mind of the offender. Both must combine to make the desertion complete. The intent to desert is usually the principal thing to be considered. Obviously a mere separation by mutual consent is not desertion in either. Nor, as a matter of proof, can desertion be inferred against either from the mere unaided fact that they do not live together, though protracted absence, with other circumstances, may establish the original intent. The courts have not laid down any particular rules of evidence for determining whether a separation does or does not, as matter of proof, amount to desertion; and the question does not admit of such rules, but each case must rest on its own circumstances.</li>

20-107.3(E)(10) allows a trial court to consider the use or expenditure of
marital property by either of the parties for a nonmarital separate
purpose, or the dissipation of such funds, when such was done after the
last separation of the parties. This subsection was added to the equitable
distribution statute in 2004. If separate property is contributed to
marital property, contributed to the acquisition of new property, or
retitled in the names of both parties, and suffers a loss of identity, the
commingled separate property is transmuted to marital property. Va. Code
Ann. § 20-107.3(A)(3)(d)-(f). In other words, if a party chooses to
commingle marital and nonmarital funds to the point that direct tracing is
impossible, the separate property loses its separate status. Even if a
party can prove that some part of an asset is separate, if the court cannot
determine the separate amount, the unknown amount contributed from the
separate source transmutes by commingling and becomes marital property.<o:p></o:p></li>

Ann. § 20-108.1(B) provides that a child support award shall be rendered
upon the evidence relevant to each individual case. However, there shall
be a rebuttable presumption that the amount of the award which would
result from the application of the guidelines set out in Va. Code Ann. §
20-108.2 is the correct amount of child support to be awarded. Once the
trial court calculates the presumptive amount of support under the
guidelines, it then determines whether deviation is required or warranted.
To justify deviation from the guidelines, the court may take into
consideration any relevant evidence pertaining to the factors enumerated
in Va. Code Ann. § 20-108.1(B).<o:p></o:p></li>

or willfully deserted or abandoned the other. It is within a trial court's
discretion to determine whether a finding of cruelty entitles a wife to a
divorce on the ground of constructive desertion. Desertion as a ground for
divorce does not depend on who actually leaves the marital home. Rather,
it means desertion of the marital relationship, and it may be
"constructive," for cruelty by one party, which results in the
other party's enforced separation. <o:p></o:p></li>

When the wife in Virginia Beach was granted a divorce a
vinculo matrimonii from the husband, the trial court awarded her monthly
alimony payments until her death or remarriage. The wife argued that such
language meant that the alimony was to continue until her death or remarriage,
regardless of the husband's death. The executrix demurred, claiming that the
obligation to pay alimony ceased at the husband's death. The trial court agreed
and dismissed the action, and the court affirmed. The decree did not expressly
or by fair implication direct that alimony was to be paid after the death of
the husband. Further, in Francis v. Francis, it was clearly established that
alimony ceased with the death of either party, unless there was an agreement to
the contrary between the parties. Further, the legislature had made no attempt
to change the Francis rule in the divorce statutes, Va. Code §§ 20-107 to
20-110 (1950). The court was thus unwilling, in the absence of clear
legislative authority, to change the settled rule from Francis by extending the
payment of alimony after the death of the husband, in the absence of such a
stipulation or contract<o:p></o:p></div>

The wife in Virginia Beach instituted a suit against the
husband alleging that a certain real property agreement entered into by them
was void and unenforceable. The agreement provided that the husband would buy
property in the names of both parties, and the wife would become jointly liable
on the mortgage note. It further provided that should either party start
proceedings to affect the marital relationship, the wife was required to convey
her interest in the property to the husband, and the husband was required to
assume all debt and hold the wife harmless from any claims regarding the
property. The chancellor held the agreement void and unenforceable on the
grounds that it was against public policy and lacked mutuality. On appeal, the
court reversed and remanded the chancellor's judgment, finding the agreement
valid and enforceable. The court held that the agreement, rather than encouraging
or facilitating a divorce or separation, tended to promote a continuation of
the marriage and that while the wife's interest in the real property could be
terminated if the husband filed suit for divorce, it was equally true that she
could at any time avoid liability on the note by filing such a suit herself.<o:p></o:p></div>

cruelty in Virginia Beach. The court ruled that, under all the circumstances,
in view of his wife's conduct, the husband was not guilty of such cruelty as
would justify desertion by her. The trial court found that there was no just
cause for the desertion and that the husband was entitled to a decree on this
ground. The court concurred in this conclusion. The court noted that the
question as to whether the wife could be held guilty of a wilful desertion such
as would entitle the husband to a divorce on the ground of desertion, in view
of a separation agreement between the parties, was a close one. The agreement
recited that the parties had mutually agreed to separate and live apart. The
court decided that the contract, while recognizing that the parties had agreed
to live apart, was entered into for the purpose of adjusting property rights
and so that the husband could avoid a jail sentence.<o:p></o:p></div>

authorizes a divorce to be granted "for cruelty" or
"reasonable apprehension of bodily hurt.". If it appears from
the whole case that the conduct of the guilty party is such as tends to
endanger the life, limb or health of the other party, or such as to render
cohabitation unsafe or improper, then the court can have no hesitation in
granting the divorce on either ground. The test is whether or not the
husband has so treated his wife as to inflict bodily injury upon her, or
cause reasonable apprehension of suffering or injury to her physically or
mentally. There is no merit in the defense that the wife's conduct caused
the husband to do and say some of the improper things which he did and
said. If the husband pours out his wrath or inflicts bodily injury upon
his wife, the wrong done her is the same, regardless of the source from
which such violence originated.<o:p></o:p></li>

distribution, however, is typically a one-time award of property acquired

award is a vested right of the recipient and, thus, not rendered moot or
voidable by a subsequent marriage between the parties. Therefore, for
equitable distribution purposes, a first divorce is not rendered void when
the same parties remarry each other; nor does the marital estate at the

20-91(A)(6) authorizes a divorce from the bond of matrimony on the ground
of cruelty. The misconduct that will form a good ground for divorce must
be very serious and such as amounts to extreme cruelty, entirely
subversive of the family relations rendering the association intolerable.
The long-established rule is that the cruelty that authorizes a divorce is
anything that tends to bodily harm and thus renders cohabitation unsafe.
Moreover, a single act of physical cruelty will constitute grounds for
divorce if it is so severe and atrocious as to endanger life or it
indicates an intention to do serious bodily harm. Before a spouse may
obtain a divorce, he or she must prove the grounds therefor and no
complaint for divorce shall be defaulted, taken for confessed, or granted
upon the pleadings or upon uncorroborated testimony.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 150%; mso-list: l0 level1 lfo1; text-align: justify;">It is not necessary that
the testimony of the complaining spouse be corroborated on every element
or essential charge stated as a ground for divorce. The corroborative
testimony need not be sufficient, standing alone, to prove the alleged
ground for divorce. Any other rule would deprive the testimony of the
complaining spouse of any practical effect. The general rule is that where
a particular fact or circumstance is vital to complainant's case, some
evidence of the same, in addition to the complainant's own testimony, is
essential. The main object of the provision of the statute requiring
corroboration is to prevent collusion. Where it is apparent that there is
no collusion, the corroboration needs to be only slight. <o:p></o:p></li>
