Virginia Court made the following holding:
- An appellate court will
not reverse a judgment of a trial court on the ground that it is contrary
to the law and the evidence unless it appears from the record that such
judgment is plainly wrong or without evidence to support it. Mere problems
between spouses, caused by unruly tempers, lack of patience, and
uncongenial natures, do not require a court to grant a divorce for fault.
Rather, a fault ground for divorce must be very serious and such as
amounts to extreme cruelty, entirely subversive of the family relations,
rendering the association intolerable.
