            Appellant former husband sought review of a judgment of the Circuit Court of Virginia Beach (Virginia), which awarded appellee former wife an absolute divorce from the husband upon the wife's bill of complaint charging willful desertion by the husband. At the same time, the trial court dismissed the husband's cross-bill in which he sought a divorce on the ground of the wife's constructive desertion.

            The Virginia Court made the following holding:

  • A husband claiming justification in an action for divorce for willful desertion has the duty of going forward with the evidence to show justification, unless wife's admissions defeats her prayer. Where the evidence presented by the husband fails to show that he had justification for leaving the wife, unless the separation was with mutual consent, the wife is entitled to a divorce on the ground of willful desertion.
