            Defendant husband challenged an order of the Circuit Court of Virginia Beach, which granted plaintiff wife's complaint for a divorce a mensa et thoro, to be merged into an absolute divorce at the proper time, on the ground of cruelty tantamount to constructive desertion and which dismissed the husband's cross-complaint for a divorce a vinculo matrimonii on the ground of cruelty tantamount to constructive desertion.
