Facts:

            The appellant husband sought review from an order of the Circuit Court of Virginia Beach (Virginia), which ordered spousal support in favor of the appellee wife. The husband asserted that the wife was precluded from seeking spousal support in a subsequent Virginia proceeding, because the divorce was obtained in Tennessee.

            The Virginia Court made the following holding:

  • Full faith and credit given a foreign divorce decree extends to property and support rights, as well as to marital status, where the divorce court had personal jurisdiction over the parties. However, when a divorce is granted ex parte the decree is binding only insofar as it terminates the marital status of the parties. Personal rights, which include property and support rights in divorce cases, may not be adjudicated by a court lacking in personam jurisdiction. This time-honored precept has been a recognized procedural due process requirement of jurisdiction.
  • In awarding spousal support, the trial judge has broad discretion. Appellate courts will not interfere unless the record shows that some injustice has been done. The trial judge must consider all the factors enumerated in Code Va. Code Ann. § 20-107.1. Consideration entails more than a recitation in the record or decree that all factors have been considered.
